Injunction Litigation
In certain cases, an individual needs to seek an injunction order from a court to preserve
the status quo. In Ohio, there are three levels of injunctive relief generally available
to a litigant.
- The first level of injunctive relief is known as a Temporary Restraining Order. It
lasts for 14 days and can be extended one time for an additional 14 days time.
- The second level of injunctive relief is known as a Preliminary Injunction. If granted,
a Preliminary Injunction can last the duration of the lawsuit.
- The third level of injunctive relief is known as a Permanent Injunction. At the end
of the litigation matter, assuming the evidence and law supports such relief, a court
can include an order that permanently enjoins certain conduct by various individuals.
The party seeking injunctive relief must be prepared to post a bond in an amount determined
by a court in case it is later determined that the parities enjoined were wrongfully enjoined
and have been damaged.
